These Terms and Conditions (the “Terms”) govern your access to and use of the websites, mobile applications, facilities, and services (collectively, the “Services”) offered by FitLife PTS (“FitLife PTS,” “we,” “us,” or “our”). Please read these Terms carefully. By accessing or using the Services, creating an account, booking a session, purchasing a package, or otherwise engaging with us, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Services.
1. Agreement to Terms
By accessing or using the Services, you represent that you have read, understood, and agree to be bound by these Terms, and that you have the legal capacity to enter into this agreement. If you are using the Services on behalf of another person or entity, you represent that you are authorized to bind them to these Terms.
2. Eligibility
The Services are intended for individuals who are at least 18 years of age. By using the Services, you represent and warrant that you are 18 or older. Certain features (such as AI-generated training programs and nutrition tracking) require age verification. We may refuse, suspend, or terminate access to anyone who does not meet these requirements.
3. Accounts and Registration
To access certain features you may need to create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly at support@fitlifepts.com of any unauthorized use or security breach. We are not liable for any loss arising from your failure to protect your credentials.
4. Description of Services
FitLife PTS provides personal training and fitness-related services, which may include in-person and small-group training sessions, online and app-based training programs (including AI-generated programs), nutrition logging and feedback tools, scheduling, and related content. We may add, modify, suspend, or discontinue any part of the Services at any time without liability, except as expressly stated in these Terms.
5. Health Disclaimer & Assumption of Risk
Physical exercise involves inherent risks, including the risk of serious injury, disability, or death. Before beginning any exercise or nutrition program, you should consult a qualified physician or healthcare provider, particularly if you have any pre-existing medical condition, injury, or are pregnant. You represent that you are in good physical health and have no condition that would prevent safe participation.
You voluntarily assume all risks associated with your participation in any training, exercise, or nutrition activity, whether in person, online, or through the app. You agree to stop and seek medical attention if you experience pain, dizziness, discomfort, or any unusual symptoms. The information and services provided by FitLife PTS are for general fitness and educational purposes only and are not medical, diagnostic, or dietary advice and are not a substitute for professional medical care.
6. AI-Generated Programs and Nutrition Content
Some programs, exercise selections, set/rep guidance, media, and nutritional estimates are generated or assisted by automated tools and artificial intelligence. Such content is provided on an “as-is” and “as-available” basis for informational purposes only, may contain inaccuracies, and should be reviewed for suitability before use. Calorie and macronutrient figures are estimates only and may not reflect actual nutritional values. You are responsible for exercising your own judgment and consulting appropriate professionals before acting on any AI-generated content.
7. Booking, Cancellations, and No-Shows
Sessions and appointments are subject to availability and to any scheduling, cancellation, and no-show policies communicated to you at the time of booking or by your trainer. Unless otherwise stated, missed sessions or late cancellations may be forfeited or charged. You are responsible for arriving on time and prepared for scheduled sessions.
8. Payments, Packages, and Pricing
Prices for sessions, packages, subscriptions, and other Services are as displayed at the time of purchase and are subject to change. Payment processing is handled by third-party providers (for example, Square); your use of those services is subject to their terms and privacy policies. You authorize us and our payment processors to charge the payment method you provide for all applicable fees and taxes. Purchased session packages may be subject to expiration dates and usage terms disclosed at purchase.
9. Gift Cards and Promotional Codes
Gift cards and promotional or coupon codes are subject to the specific terms disclosed at issuance, including any expiration dates, usage limits, and eligibility restrictions. Unless required by law, gift cards and promotional credits are non-transferable, non-refundable, and may not be redeemed for cash. We reserve the right to void codes that are obtained or used fraudulently or in violation of their terms.
10. Refunds
Except where required by applicable law or expressly stated in a specific offer, all sales are final and fees are non-refundable. Any refund or credit granted is at our sole discretion and does not obligate us to provide future refunds or credits.
11. Text Messaging (SMS) Terms
By opting into SMS notifications, you agree to receive appointment reminders and account updates. Message and data rates may apply. Message frequency varies. You can unsubscribe at any time by replying STOP. For help, reply HELP or contact support@fitlifepts.com. Consent to receive text messages is not a condition of purchasing any goods or services. Carriers are not liable for delayed or undelivered messages.
12. User Conduct and Acceptable Use
You agree to use the Services only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Services by, any third party. You agree not to: (a) violate any applicable law or regulation; (b) upload or transmit content that is unlawful, harmful, harassing, or objectionable; (c) attempt to gain unauthorized access to any systems or accounts; (d) interfere with or disrupt the integrity or performance of the Services; or (e) misrepresent your identity or affiliation.
13. Intellectual Property
All content, trademarks, logos, program designs, videos, text, graphics, and software associated with the Services are owned by or licensed to FitLife PTS and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and their content for your personal, non-commercial use. You may not copy, reproduce, distribute, resell, or create derivative works from any part of the Services without our prior written consent.
14. User Content
You retain ownership of content you submit (such as photos of meals or notes). By submitting content, you grant FitLife PTS a non-exclusive, worldwide, royalty-free license to host, store, process, and use that content solely as necessary to provide and improve the Services. You represent that you have the rights to the content you submit and that it does not violate any law or third-party rights.
15. Third-Party Services and Links
The Services may integrate with or link to third-party services (such as payment processors, messaging providers, calendars, and video platforms). We do not control and are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their respective terms.
16. Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Services, you consent to the practices described in the Privacy Policy.
17. Disclaimers
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY PARTICULAR FITNESS OR HEALTH RESULT WILL BE ACHIEVED. INDIVIDUAL RESULTS VARY.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITLIFE PTS AND ITS OWNERS, TRAINERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
19. Indemnification
You agree to indemnify, defend, and hold harmless FitLife PTS and its owners, trainers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
20. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
21. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey, and you consent to personal jurisdiction and venue there.
22. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
23. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
24. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms applicable to specific Services, constitute the entire agreement between you and FitLife PTS regarding the Services and supersede any prior agreements. Our failure to enforce any provision is not a waiver of that provision.
